The health and temperament of this dog is excellent to the best of our knowledge and belief at the time of sale. The required vaccinations and worming’s are as indicated on the health record. We advise the Buyer however to have the dog examined by a licensed veterinarian of Buyers choice within 72 hours after receipt of the dog. We recommend you take a stool sample with you. If the veterinarian finds the dog to be in poor health, the dog must be immediately returned to us at the expense of Buyer, for a replacement of equal value, unless other arrangements are mutually agreed upon. Failure to see a veterinarian within 72 hours will void all guarantees. No further guarantee is made.
Buyer represents that he/she is buying this puppy/dog primarily as a personal or family companion even though the dog may have shown quality structure. Buyer understands dog is not guaranteed for show or breeding and buyer has no obligation to seller for showing or breeding this dog. (Nor for sharing stud fees for puppies resulting thereof)
Hip Dysplsia (HD) can develop from genetic or environmental causes. Purchaser acknowledges that a quality diet is essential to maintaining the dog’s health, and that overfeeding and excessive exercise early in the puppy’s life my cause it to develop HD or other health risks later in life. Nonetheless, ACA Pure German Shepherds will assume the risk for Crippling HD until the dog reaches five years of age. Confirmed by X-rays by a licensed Veterinarian and confirmed by the Orthopedic Foundation for Animals.
A) Keeping the dog diagnosed with HD. Purchaser acknowledges that ACA Pure German Shepherds has no warranty obligations, all warranties in the Agreement are void and unenforceable, and Purchaser has no right to a replacement dog from ACA Pure German Shepherds if Purchaser chooses to keep the Dog after it is diagnosed with HD, or if Purchaser otherwise fails to notify ACA Pure German Shepherds of the Dog’s diagnosis of HD within 10 business days of that diagnosis.
B) Replacement Dog: The Dog is to be returned to us at the expense of the buyer. This is a replacement guarantee only, with a puppy of equal value at time of purchase as soon as possible. There is no guarantee on a replacement puppy/dog.
Care for the puppy/dog: Purchaser agrees to provide good care to the Dog, including proper nutrition (premium dog food), shelter, exercise, immunizations, veterinary care, and socialization. Purchaser agrees to not overfeed the Dog or subject it to excessive exercise, especially before the dog is One Year of age. ACA Pure German Shepherds is not responsible for care or expenses for the Dog after the Possession Date.
Jurisdiction and Choice of Law: The parties agree that all provisions of the Agreement, and any disputes arising out of it, shall in all respects be governed by the laws of the State of Illinois. Any action arising out of this Agreement shall be brought exclusively in the Courts of Kendall County of the State of Illinois.
Entire Agreement. This written Agreement contains the entire understanding between Purchaser and ACA Pure German Shepherds and supersedes all previous written or oral agreements. Any amendment of modification to the Agreement may only be made in writing and must be signed by Purchaser and ACA Pure German Shepherds.
By signing below, the parties acknowledge that they have read this Agreement in its entirety, fully and completely understand the terms of this Agreement and their effect, and enter into this Agreement freely, knowingly, and voluntarily.
